Please read carefully. This agreement affects your legal rights.

1. Assumption of Risk

I understand that attending or participating in Pup Festival at Tempe Marketplace involves interaction with dogs, people, event equipment, vendors, and outdoor or public spaces. Risks may include dog bites or scratches; unpredictable animal behavior; falls; collisions; allergic reactions; exposure to illness; property damage; and injury to me, my dog, or other people or animals. I knowingly and voluntarily assume all inherent and reasonably foreseeable risks of attending or participating in the event.

2. Participant Responsibilities

I am responsible for supervising and controlling any dog I bring to the event. I represent that my dog is appropriately vaccinated as required by law, is not known to be dangerous or contagious, and is suitable for attendance in a crowded public environment. I agree to follow event rules, venue rules, posted instructions, and reasonable directions from event personnel. Pup Festival may refuse entry or require any attendee or animal to leave when reasonably necessary for safety.

3. Release and Waiver

To the fullest extent permitted by Arizona law, I release and waive claims against Pup Festival LLC, Tempe Marketplace and its applicable owner and management entities, the event sponsors and vendors, and each of their respective owners, officers, employees, agents, contractors, and volunteers (collectively, the “Released Parties”) for personal injury, death, property damage, or other loss arising from my or my dog’s attendance at or participation in the event, including claims arising from the ordinary negligence of a Released Party.

This release does not apply to gross negligence, reckless conduct, intentional misconduct, or any liability that cannot lawfully be waived.

4. Responsibility for My Dog

I accept responsibility for injury, damage, or loss caused by me or by any dog under my care or control. To the fullest extent permitted by law, I agree to reimburse the Released Parties for third-party claims, damages, and reasonable costs resulting from my or my dog’s conduct, except to the extent caused by a Released Party’s gross negligence, reckless conduct, or intentional misconduct.

5. Medical Care

If I am unable to provide consent during an emergency, I authorize event personnel to contact emergency services on my behalf. I understand that I remain responsible for resulting medical or veterinary expenses. Event personnel are not required to provide medical or veterinary care.

6. Acknowledgment

I confirm that I have read and understand this agreement, have had the opportunity to ask questions, and accept it voluntarily. I understand that I am giving up substantial legal rights, including the right to bring certain claims for ordinary negligence.

If registering a minor, the minor’s parent or legal guardian must complete a separate parent/guardian agreement approved for use with minors. One adult may not accept this waiver for another adult attendee.
